1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and SukuLink ("Company," "we," "us," or "our") governing your access to and use of the SukuLink website, mobile applications, and related services (collectively, the "Platform").

By accessing or using our Platform, you agree to these Terms. If you do not agree to these Terms, you must not access or use the Platform.

These Terms apply to all users of the Platform, including students, parents, teachers, educational institutions, and visitors.

2. Eligibility

To use SukuLink, you must:

• Be at least 13 years old, or have parental/guardian consent if under 13
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using the Platform under applicable laws
• Provide accurate and complete registration information

If you are registering on behalf of an organization (such as a school), you represent that you have the authority to bind that organization to these Terms.

For users under 18: If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

3. Account Registration

3.1 Account Creation

To access certain features, you must create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Not share your account credentials with others
• Notify us immediately of any unauthorized access

3.2 Account Responsibility

You are responsible for all activities that occur under your account. We reserve the right to suspend or terminate accounts that violate these Terms or for any other reason at our sole discretion.

3.3 Account Types

• Student Account: For individual learners
• Parent Account: For monitoring linked student accounts
• Teacher Account: For educators creating content and tracking students
• Institution Account: For schools with administrative privileges

4. Our Services

SukuLink provides an AI-powered educational platform that includes:

• AI Tutoring services for academic subjects
• Past examination questions database (BECE, WASSCE, NECO, JAMB)
• Study materials and notes
• Quiz generation and practice tests
• Progress tracking and analytics
• Timetable management (for institutions)
• Report card generation

We reserve the right to modify, suspend, or discontinue any part of our services at any time, with or without notice.

5. Subscriptions & Payments

5.1 Subscription Plans

SukuLink offers the following subscription tiers:

• Free: Limited access to basic features
• Silver: Enhanced features with monthly AI query limits
• Gold: Full access to all features with unlimited usage
• Institution Plans: Bulk subscriptions for schools

5.2 Billing

• Subscriptions are billed in advance on a monthly or annual basis
• Prices are displayed in your local currency (GHS, NGN, USD)
• All fees are exclusive of applicable taxes unless stated otherwise
• We accept payments via Paystack, Flutterwave, and mobile money

5.3 Automatic Renewal

Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You will be charged the then-current subscription fee.

5.4 Cancellation

• You may cancel your subscription at any time from your account settings
• Cancellation takes effect at the end of your current billing period
• You retain access to paid features until your subscription expires
• No partial refunds are provided for unused portions of a billing period

5.5 Refunds

We offer a 7-day money-back guarantee for first-time subscribers. Refund requests after this period will be reviewed on a case-by-case basis. To request a refund, contact [email protected].

5.6 Price Changes

We may change subscription prices with 30 days' notice. Price changes will apply at the start of your next billing period. Continued use after the price change constitutes acceptance.

6. Acceptable Use

You agree to use SukuLink only for lawful educational purposes. You may:

• Access study materials for personal learning
• Use the AI tutor for academic assistance
• Practice with past questions and quizzes
• Track your learning progress
• Share your achievements on social media
• Provide feedback and suggestions

7. Prohibited Conduct

You agree NOT to:

7.1 Account Abuse

• Share your account credentials with others
• Create multiple accounts to abuse free trials
• Use automated scripts or bots to access the Platform
• Attempt to gain unauthorized access to other accounts

7.2 Content Violations

• Upload malicious, offensive, or inappropriate content
• Distribute copyrighted materials without permission
• Upload viruses, malware, or harmful code
• Post spam, advertisements, or promotional materials

7.3 Academic Dishonesty

• Use SukuLink to cheat on official examinations
• Share examination answers during live tests
• Misrepresent your identity or academic credentials
• Submit AI-generated content as your own original work without disclosure

7.4 Platform Abuse

• Attempt to reverse engineer or hack the Platform
• Interfere with Platform operation or servers
• Scrape or harvest data from the Platform
• Circumvent security measures or access controls

7.5 AI Tutor Misuse

• Use the AI tutor for non-educational purposes
• Attempt to extract harmful or inappropriate content
• Use prompt injection or manipulation techniques
• Generate content that violates laws or regulations

8. Intellectual Property

8.1 Our Content

All content on the Platform, including but not limited to text, graphics, logos, images, audio, video, software, and study materials, is the property of SukuLink or its licensors and is protected by copyright, trademark, and other intellectual property laws.

8.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for personal, non-commercial educational purposes, subject to these Terms.

8.3 Restrictions

You may not:

• Copy, modify, or distribute our content without permission
• Use our trademarks or branding without authorization
• Remove copyright notices from any materials
• Create derivative works based on our content
• Sell or commercially exploit Platform content

8.4 Third-Party Content

Examination questions from WAEC, NECO, and JAMB are used for educational purposes. These remain the property of their respective examination bodies.

9. User Content

9.1 Your Content

"User Content" includes any content you submit, upload, or create on the Platform, such as questions to the AI tutor, uploaded documents, notes, and feedback.

9.2 License Grant

By submitting User Content, you grant SukuLink a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content for the purpose of operating and improving the Platform.

9.3 Your Responsibility

You are solely responsible for your User Content. You represent that you own or have the necessary rights to submit such content and that it does not violate any third-party rights.

9.4 Content Moderation

We reserve the right to review, remove, or disable access to any User Content that violates these Terms or is otherwise objectionable, without prior notice.

10. AI Services

10.1 AI Tutor

Our AI tutor is powered by advanced language models and is designed to assist with educational queries. The AI provides explanations, answers questions, and helps with learning, but:

• AI responses may not always be accurate or complete
• AI should not replace human teachers or professional advice
• AI is not infallible and may occasionally produce errors
• AI responses are for educational purposes only

10.2 AI Limitations

Our AI tutor is programmed to be honest about its limitations. If it doesn't know an answer, it will say so rather than making up information. We continuously work to improve accuracy.

10.3 AI Data Usage

Conversations with the AI tutor may be used (in anonymized form) to improve our services. Personal information is handled according to our Privacy Policy.

11. Termination

11.1 Termination by You

You may terminate your account at any time by contacting us or using the account deletion feature. Upon termination, your right to use the Platform ceases immediately.

11.2 Termination by Us

We may suspend or terminate your account if:

• You violate these Terms
• You engage in fraudulent or illegal activities
• Your payment method fails repeatedly
• We believe your use poses a security risk
• Required by law or government order

11.3 Effect of Termination

Upon termination:

• Your access to the Platform will be disabled
• Your data may be deleted after 30 days
• No refunds will be provided for prepaid subscriptions
• Provisions that should survive termination will remain in effect

12. Disclaimers

We disclaim all warranties, including but not limited to:

• Merchantability and fitness for a particular purpose
• That the Platform will be uninterrupted or error-free
• That defects will be corrected
• That the Platform is free of viruses or harmful components
• Accuracy or reliability of any content or information

Educational Disclaimer: SukuLink is a supplementary educational tool and does not guarantee academic success or examination results. Success depends on individual effort and various factors beyond our control.

13. Limitation of Liability

This includes, but is not limited to, damages for:

• Loss of profits, data, or goodwill
• Service interruption or system failure
• Unauthorized access to your account
• Errors or inaccuracies in content
• Any third-party conduct on the Platform

Our total liability for any claims arising from these Terms or your use of the Platform shall not exceed the amount you paid us in the 12 months preceding the claim, or $100 USD, whichever is greater.

14. Indemnification

You agree to indemnify, defend, and hold harmless SukuLink, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the Platform
• Your violation of these Terms
• Your violation of any third-party rights
• Your User Content
• Any fraudulent or illegal activity

15. Governing Law & Dispute Resolution

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Ghana, without regard to its conflict of law provisions.

15.2 Dispute Resolution

Any disputes arising from these Terms shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in Accra, Ghana, under the rules of the Ghana Arbitration Centre.

15.3 Class Action Waiver

You agree that any disputes will be resolved individually and not as part of any class, consolidated, or representative action.

16. Changes to These Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by:

• Posting the updated Terms on the Platform
• Sending an email notification
• Displaying a prominent notice on our website

Changes become effective 30 days after posting unless stated otherwise. Your continued use of the Platform after changes constitute acceptance of the modified Terms.
